She did influence him in one obvious way — encouraging Kitzhaber to walk his talk by driving a Prius instead of a gas-guzzling SUV. With another boyfriend, she purchased some farmland in rural Washington with the idea of starting a marijuana farm well before it was legala project that never got off the ground.
She was not prosecuted, and the two bad judgments remained hidden from her public life story until both were exposed by the media in the fall of Hayes voluntarily left behind the people that she had been associating with during that time and started building a new life.
She moved to central Oregon, got deeply involved in environmental and energy issues — her passion — and formed a nonprofit called 3E Strategies that she later turned into a private consulting business. InHayes was named to then-Gov. When Kitzhaber became governor again inHayes stepped into the first lady role.
There is little question that she wore that mantle while promoting several political causes: In each case, they were causes the governor also believed in. They started with charges that Hayes used state workers, including Mary Rowinski, her personal assistant as first lady, to take care of her pets, run personal errands, and arrange some travel for her energy consulting work.
While these may technically be violations of stringent state ethics laws, they seem quite minor. Since the money was actually paid to her company, that seems a real possibility.
Critics also charged that the fellowship bought political influence for CEDC. But its director, Jeffrey King, maintains that none of the money had been used to shape Oregon policy and that he never met with or tried to influence Kitzhaber.

But on the other hand, they were accusing Hayes of too much activity promoting clean energy. Indeed, Hayes performed significant work for CEDC, but much of it was outside the state of Oregon, and it had ended prior to clean energy legislation being proposed by Kitzhaber. Beginning in JanuaryHayes also no longer accepted outside paid work and, in her role as first lady, acted solely as a volunteer in promoting her poverty and environmental causes.
Given business and other expenses, her actual earnings may have been far less than that. In truth, Hayes is a passionate, effective advocate for her issues and a gifted, charismatic communicator. Hayes wanted to have a career and an impact beyond that of first lady. My first conversation with Hayes, inincluded a discussion of GPI, a project dear to her heart and to Kitzhaber, who says he has been aware of the problems with using Gross Domestic Product GDP to assess economic success since he first heard Sen.
Robert Kennedy discuss the subject in It counts all monetary expenditures, including the costs of cleaning up oil spills, treating cancer, etc. The authors called for starting with GDP but then subtracting the cost of defensive expenditures like environmental cleanups, loss of resources, and cancer treatments, while adding the value of housework and other useful unpaid activities. Hayes became an effective national spokeswoman for the concept, and helped organize a conference in Maryland promoting the idea, at which she and then-Maryland Gov.
The Oregonian insinuated that Kitzhaber was improperly influenced by Hayes in doing so, despite the fact that he had been interested in alternative measures of progress long before he met her. The April meeting was … organized by a coalition of organizations and governments pushing for worldwide use of the measure.
It was an educational trip, not a junket to a tropical beach at taxpayer expense. The only thing infamous about the trip was the scorn heaped on it by the Republicans and The Oregonian. But why let the facts get in the way of a good Portlandia joke? Rather, GPI is the most popular alternative measure around, currently being considered by a host of states, including deeply red ones like Utah. But in all of this, a sensation-seeking media, which hounded a governor out of office without proof of ethical misconduct, has much to answer for.

The following is an exchange between Douglass and Hayes: Kitzhaber learn that you would not be facing criminal charges? I learned it from the media just like everybody else did. A Google Alert came up with my name on it. It was not immediately celebratory.Governor John Kitzhaber on the Issues
It felt heavy and I think there was a sense of, 'Is it really real? Is it finally over? What duties did the title of 'first lady' actually entail? There is no job description.
There isn't even established protocol for a first lady. I didn't mean official title. There's no official role or position. It's all unofficial if you're not an actual employee, which I wasn't. Joe, I've gotta say, all of these kinds of questions, I feel like I know where you're going with this and I feel like it's an effort to continue the false narrative.
All of this is what they focused on and we were cleared. You're connected to the governor's office. So see, this is what, this is what I've dealt with with the media. Even the way you framed that question proves that you're coming in with a false assumption about the truth and about me.

I was doing a lot of that kind of work for years before I even knew John Kitzhaber. We understand that it's not illegal but is it appropriate? All I know is I was just stood up to two-and-a-half years of federal investigations and have been cleared.
Justice Department has offered no details as to why it did not pursue criminal charges. Supreme Court decision last year likely had a big influence.
The High Court's decision effectively overturned bribery convictions of former Virginia Gov. Bob McDonnell and his wife. They're two completely different circumstances. And I feel really good about how I've handled this. Kitzhaber, is there a date yet for a wedding? We hadn't thought about it.
I think, um, really we wanted all of this to be behind us before we thought about that next step and it, you know, um, no, we haven't set a date but we're golden and I'm blessed. She said they published multiple errors while breaking the story that ultimately led to Kitzhaber's resignation. We proudly stand by our story.
Every response I gave to him was in writing and I still have that document. John Kitzhaber about Ms. Hayes' private consulting contracts and apparent conflicts of interests, issues that had caused concern among Gov. From that point until the publication of our story, 'First Lady Inc. Hayes repeatedly declined to be interviewed or to respond to written questions.
After the publication of that article, WW continued to follow the story, including the attempt by Gov. Kitzhaber's office to remove emails from the state server, an effort that led a whistleblower to turn those emails over to WW.
